Does my employer have to offer a disability insurance plan?

In most states, no.  However, California, Hawaii, New Jersey, New York, Rhode Island, and Puerto Rico, all require employers to offer state disability insurance programs for employees.

The laws in Puerto Rico and California, Hawaii, New Jersey, New York, Rhode Island do not require an employer to pay the entire premium on your behalf. Depending upon where you work you may need to pay a portion of the disability insurance premium. How much an employer in California, Hawaii, New Jersey, New York, Rhode Island, Puerto Rico can require an employee to contribute to disability insurance premiums varies.

Disability insurance provides coverage in addition to any Worker's Compensation and Social Security benefits you may also be eligible through the government.

How do I know if I already have disability insurance through my employer?

If you live in a state that requires your employer to purchase disability insurance on your behalf, and your employer pays the entire premium for you, you may have disability insurance coverage and not know it.

Ask your employer if you already have coverage through a group plan or if you can purchase disability insurance through a group plan.
